A New Sunscreen Active Does Not Make Every Formula Market-Ready

FDA added bemotrizinol to the OTC sunscreen monograph effective August 9, 2026. Learn how to assess eligibility and exclusivity, translate monograph conditions into design inputs, and build the reformulation evidence package.

The order is effective, but the commercial path is specific

On June 9, 2026, FDA announced that it had added bemotrizinol as a permitted active ingredient under the OTC sunscreen monograph. The final administrative order takes effect on August 9, 2026, unless disputed under the statutory process described in the order.

That timing makes the topic immediate for topical OTC drug manufacturers. It does not mean that every company can add bemotrizinol to any sunscreen formula and launch. The final administrative order defines specific conditions for products containing the ingredient and explains an 18-month exclusivity tied to the order requestor, DSM Nutritional Products LLC, or its licensees, assignees, or successors with respect to the order.

Start with eligibility and exclusivity

Create a documented threshold decision before formulation work begins. Identify the legal entity proposing to market the product, its relationship to the order requestor, the intended launch date, the product configuration, and the regulatory basis for eligibility.

The final order says the statutory exclusivity lasts 18 months beginning on the date DSM may lawfully market drugs incorporating the change, subject to the order. That language needs qualified review. Commercial teams should not treat the ingredient’s addition to the monograph as a general immediate opening for all suppliers and marketers.

Separate four questions:

  1. Is the active ingredient condition now part of OTC Monograph M020?
  2. Does the proposed marketer have a lawful path during the exclusivity period?
  3. Does the finished formulation conform to every applicable monograph condition?
  4. Are the manufacturing, testing, labeling, listing, quality, and distribution controls ready?

A positive answer to the first question does not answer the other three.

Translate monograph conditions into design inputs

FDA concluded that bemotrizinol can be generally recognized as safe and effective for sunscreen use under specified conditions. The order permits a concentration up to and including 6 percent and requires the finished product to provide a minimum SPF of at least 2 when measured under the monograph testing procedures.

The order also defines permitted combinations with other sunscreen and certain skin-protectant active ingredients, excluding specified combinations involving PABA or trolamine salicylate. It identifies permitted dosage forms, including oil, lotion, cream, gel, butter, paste, ointment, stick, and spray when the additional spray conditions are met.

Convert these conditions into controlled formulation inputs. Include active concentration, permitted co-actives, dosage form, SPF target, testing method, labeling conditions, impurity controls, supplier specifications, container-closure expectations, and any spray-specific requirements.

The design review should compare the proposed formula against the current monograph text, not a press release or supplier summary. Record the version and effective date of the source used for the decision.

Build a reformulation evidence package

Treat the addition of a new active as a significant product lifecycle project even when the finished drug can be marketed under the monograph pathway.

Supplier and material controls

Qualify the active-ingredient supplier and define identity, assay, impurity, storage, transportation, retest, change-notification, and traceability requirements. Confirm how the supplied material relates to the substance evaluated for the order. Supplier qualification should address the manufacturer’s intended controls, not assume that FDA’s review of the order request replaces incoming-material governance.

Formulation and process development

Document how bemotrizinol behaves in the chosen dosage form and combination. Evaluate mixing, solubility or dispersion, homogeneity, hold times, scale-up, filling, packaging interaction, and cleaning. Identify critical material attributes and process parameters that could affect concentration, uniformity, performance, or stability.

Finished-product testing

Build a test strategy that supports the applicable monograph and quality requirements. Link SPF and broad-spectrum-related work, when applicable, to the exact formula and process. Define release specifications and validated or otherwise appropriately controlled methods for identity, strength, quality, purity, and other relevant attributes.

Stability and packaging

Assess whether the new active or changed formula affects photostability, physical stability, preservative performance, impurities, color, odor, viscosity, spray performance, or container compatibility. The expiration-dating rationale should be supported by product-specific evidence.

Labeling and records

Update Drug Facts and other labeling through controlled review. Check active-ingredient statements, directions, warnings, claims, dosage form, net contents, and product identifiers. Make sure product listing, artwork, specifications, batch records, test methods, training, and release documentation all point to the same approved configuration.

Control launch claims and market records

The new ingredient may attract marketing interest, but claims still need regulatory and evidence review. A statement that FDA amended the monograph under specified conditions is different from an FDA endorsement of a brand or a promise about clinical outcomes.

Create a claims matrix that identifies each proposed statement, its regulatory category, supporting evidence, approved wording, channel, and owner. Review websites, retailer content, social copy, distributor materials, and product packaging together. A controlled label paired with uncontrolled digital claims is not a complete launch system.

Update complaint and adverse-event coding so post-market data can distinguish the new formula and ingredient. Link the formula version to lots, distribution, and market dates. If a safety, stability, or performance signal emerges, the team should be able to identify the affected configuration quickly.
